Terms of Service

Effective · Version 1.1

These Terms of Service (the “Terms”) are a binding agreement between you and Red Flags (“Red Flags”, “we”, “us”) and govern your use of find-red-flags.com and everything we offer through it (the “Service”). Our Privacy Policy, which explains how we handle information about you and about the people you search, is part of these Terms. Please read both. The “In short” notes under each heading are a courtesy; the full text of each section is what you agree to.

These Terms include an agreement to resolve disputes by individual arbitration and a waiver of class actions (Section 22).

Four rules that never bend.

  • Red Flags is not a consumer reporting agency. Nothing we provide is a consumer report under the Fair Credit Reporting Act, and you may not use it to decide anyone’s eligibility for employment, credit, insurance, housing, or any similar purpose.

  • Never stalk, harass, or harm. You may not use the Service to intimidate, threaten, or track anyone, or to find someone who does not want to be found. Whom you search, and why, is your decision and your responsibility alone; misuse ends your account, and it may be a crime.

  • Results are leads, not proof. They come from third-party and public sources, can be wrong or incomplete, and can belong to a different person with the same name. Verify before you act, and never act against someone on a result alone.

  • Search only for a lawful, personal reason — your safety, someone you are dating or in a relationship with, or your own footprint. Never search for a child.

These four rules summarize Sections 2 through 9. Everything on this page is part of the agreement.

Contents

Agreement, eligibility, and changes

In short

Using Red Flags means you accept these Terms. You must be 18 or older. We can update the Terms; a material change gets 14 days’ notice, and using the Service after it takes effect means you accept it.

What Red Flags is, and what it is not

In short

Red Flags runs one-off searches of third-party and public sources and shows you what comes back. We are not a consumer reporting agency, not a private investigator, and not a source of legal advice. Results are leads, not conclusions.

Permitted use

In short

Use the Service for your own lawful, personal, non-commercial purposes — safety before a date, understanding someone you are in a relationship with, or checking your own online footprint. Never in the course of a business, and never on someone else’s behalf.

Prohibited purposes: no eligibility decisions

In short

You may not use anything from the Service to decide whether someone gets a job, credit, insurance, housing, a license, a benefit, or anything else the FCRA or a similar law covers — and you certify that you will not.

Prohibited conduct: stalking, harassment, and harm

In short

Never use the Service to stalk, harass, threaten, intimidate, expose, discriminate against, or hurt anyone, or to find someone who has cut off contact. Never search a child. Misuse ends your account at once, and we cooperate with law enforcement.

Searching another person

In short

You are responsible for whom you search and why. Use only identifiers you obtained lawfully, treat every result as a lead, verify before you rely on it, and never take action against someone based on a Report alone.

Sex offender registry checks

In short

A registry check searches public sex-offender registries for possible name matches. It is a name match, not proof that the person you searched is a registrant. Registry data comes with legal conditions of use, which you accept when you run a check.

Breach and credential data

In short

Some results come from public data-breach records. Use them only to understand exposure — never to access an account or to guess a password.

Your account

In short

One account per person, tied to your email address. There is no password: anyone who can open your sign-in link or code can open your account, so keep your inbox secure.

Membership, introductory period, renewal, and cancellation

In short

Membership is a monthly subscription that renews automatically at the price shown at checkout until you cancel. A first membership starts with a paid 7-day introductory period. Cancel any time from Settings; it takes effect at the end of the period you have paid for, and we do not prorate. You can ask for a refund of any charge within 7 days of it.

Searches, credits, and add-ons

In short

Each search spends one search credit. The introductory period includes one credit and each paid month includes five; unused credits do not carry over. Add-ons are one-time charges per Report.

Refunds and billing disputes

In short

Ask within 7 days of any charge and we refund it to your original payment method. After that, charges are final except where the law says otherwise or where these Terms say a credit is returned. If you think a charge is wrong, email us within 30 days before disputing it with your bank.

Accuracy of results and your Reports

In short

We show you what the sources returned at the moment you searched. We do not guarantee that it is accurate, complete, current, or about the right person, and no result is a verdict on anyone.

Our content and your license

In short

We license you the Service and your Reports for personal use. Do not copy the site, scrape it, automate searches, resell results, or build anything on top of it.

Third-party services

In short

Results come from third-party data providers and payments go through Stripe. We do not control them and are not responsible for them, and our providers’ acceptable-use rules bind you as well.

Privacy

In short

Our Privacy Policy explains what we collect about you and about the people you search, how long we keep it, whom we share it with, and the choices available to you and to them.

Enforcement, suspension, and termination

In short

Break these Terms and we can suspend or close your account at once, without a refund, and withhold your Reports. We may investigate misuse and disclose it where the law requires or permits. You can close your account any time by emailing us.

Disclaimer of warranties

In short

The Service and every Report are provided as is. We make no promise that they are accurate, complete, uninterrupted, or fit for your purpose.

Limitation of liability

In short

We are not liable for indirect or consequential losses, for the actions of the people you search or of third parties, or for decisions you make based on a Report. Our total liability is capped at what you paid us in the past 12 months, or US$100 if that is more.

Indemnification

In short

If your use of the Service, your breach of these Terms, or something you do with a Report causes a claim against us, you cover it.

Dispute resolution: arbitration and class waiver

In short

If we have a dispute, we first try to work it out by email for 60 days. If that fails, it goes to binding individual arbitration (or small-claims court), not to a jury or a class action. You can opt out of arbitration within 30 days of first accepting these Terms. Where consumer law forbids advance arbitration agreements, this section does not apply.

Governing law and venue

In short

These Terms are governed by Ontario law. Arbitration under Section 22 is your only way to bring a claim against us; you waive court claims, jury trials, and class actions to the fullest extent the law allows, and anything that does reach a court is heard in Ontario.

Notices for particular places

In short

Some places require specific notices or give you rights these Terms cannot take away. Those rights apply.

General terms

In short

The usual final provisions: this is the whole agreement, unenforceable parts are severed, we can assign it, notices go by email, and English controls.

Contact

In short

Questions, notices, and misuse reports all go to one address.
